By accessing or using AI Baby Dance ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

AI Baby Dance is an AI-powered video generation service that transforms photos into dancing videos. Our Service includes:

• Photo-to-video generation using AI technology
• Multiple dance templates and motion styles
• Video download in MP4 format
• Free tier and paid subscription plans

Processing Time: Video generation typically takes 5-15 minutes depending on video length and server load. We do not guarantee specific processing times.

3. User Accounts

3.1 Registration

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3.3 Age Requirement

You must be at least 13 years old to use our Service. If you are under 18, you must have parental or guardian consent.

4. Acceptable Use Policy

You agree NOT to use our Service to:

• Upload photos you do not have the right to use
• Upload photos of people without their consent (or guardian consent for minors)
• Create illegal, harmful, threatening, abusive, or harassing content
• Create deepfakes or misleading content intended to deceive others
• Generate NSFW, pornographic, or sexually explicit content
• Create content that infringes on intellectual property rights
• Impersonate others or create content for fraudulent purposes
• Upload nude, sexual, violent, illegal, or non-consensual media
• Use a real person's image or video without permission or lawful authority
• Attempt to reverse engineer, hack, or exploit our AI systems
• Use automated tools or bots to abuse the Service
• Resell or redistribute our Service without authorization

Media Safety Review: User-uploaded photos and reference videos may be automatically screened before generation for nudity, sexual content, violence, illegal content, and other unsafe material. Content that fails review will be blocked before generation and credits will not be charged for that blocked attempt.

Consent Requirement: By uploading a photo or video of a person, you confirm that you have the right and consent to use that media. Attempts to bypass these safeguards, repeated violations, or abusive use may result in content removal, account suspension, or termination.

5. Content Ownership and License

5.1 Your Content

You retain ownership of photos you upload. By uploading content, you grant us a limited, non-exclusive license to process your photos solely for the purpose of generating videos.

5.2 Generated Videos

You own the videos generated for you, subject to these Terms and your subscription plan. You are responsible for ensuring you have the right to use any photos you upload.

5.3 Our Service

AI Baby Dance, including our AI models, templates, website, and platform, remains our exclusive property.

6. Subscriptions and Payments

6.1 Plans

We offer Free, Basic, Creator, and Pro subscription plans with different features and credit allocations.

6.2 Billing

Paid subscriptions are billed monthly or annually in advance. Prices are subject to change with 30 days notice.

6.3 Credits

Credits are used to generate videos. Unused subscription credits expire at the end of each billing period. Purchased credit packs do not expire.

6.4 Cancellation

You may cancel your subscription at any time. Your subscription will remain active until the end of the current billing period.

7. Refund Policy

All purchases of credits and subscriptions are final and non-refundable. Credits are virtual goods that can be used immediately upon purchase.

We provide refunds or credits ONLY in these cases:

• Failed generations: Credits are automatically refunded if video generation fails due to system errors
• Duplicate charges: Full refund for accidental duplicate payments

Refunds are NOT available for:

• Purchased credits (used or unused)
• Subscription fees (partial months or unused time)
• Dissatisfaction with AI-generated results (quality varies)
• Violation of our Terms of Service

For duplicate payment issues, contact us at support@aibabydance.app. Please try our free credits before making a purchase.

8. Commercial Use

• Free/Basic Plans: Personal, non-commercial use only. Please credit "aibabydance.app" when sharing publicly.
• Creator/Pro Plans: Commercial use is permitted. You must have rights to all uploaded photos.

9. Disclaimer of Warranties

AI Baby Dance is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not guarantee:

• Uninterrupted or error-free service
• Specific results, quality, or accuracy of generated videos
• That the Service will meet your specific requirements
• Specific processing or generation times

10. Limitation of Liability

To the fullest extent permitted by law, AI Baby Dance and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use or inability to use the Service
• Any content generated through the Service
• Unauthorized access to your account
• Any third-party conduct on the Service

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless AI Baby Dance from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination:

• Your access to the Service will be revoked
• Unused credits will be forfeited
• Your data will be deleted according to our Privacy Policy

You may delete your account at any time through your account settings.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the new Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to conflict of law principles.
